 Pet Contract & Sales Agreement
 
This sales contract and agreement entered into this _________ day of _____________________,
20______ between Janit L. Johnson hereinafter referred to as Seller and ___________________
__________________________________________ hereinafter referred to as Buyer (s) residing at ___________________________________________________________________________

              In the consideration of the sum of $__________ such being the purchase price and all the mutual 
               promises contained hereinafter, seller promises and agrees to transfer ownership (see condition #4)
               to buyer of a Pet Quality Keeshond, hereinafter referred to as Said Dog, being of male/female sex
               and being of gray silver & black color.  A non-refundable deposit of $250.00 is required for holding
               of Said Dog with this amount being applied toward the total purchase price.  Should no puppy
be available, deposit will be refunded or applied to next available litter.  Choice shall be
that of the Buyer. 

          Pet Quality means that said dog is not of Show Quality nor is it eligible be used for
             breeding purposes.

 

                                                          FURTHER CONDITIONS FOR THIS SALE SHALL BE AS FOLLOWS:

1.          Said dog shall be registered with AKC on a limited registration with Seller reserving the right to select the AKC name
     of Said Dog.  No other name shall be added to the AKC name in which Seller selects.   Said Dog shall not be registered
     with any other Registry without the written consent of the Seller.  Registration application will be held by Seller until
     proof of neuter or spay has been received by Seller.
 

      2.         Shipping and/or transportation cost to be solely the responsibility of the Buyer at all times.
 

      3.         The Seller does hereby warrant that Said Dog is in good health and that Seller will replace any dog which is not in good
                  health, provided Buyer takes said dog to a Veterinarian within 7 working days of possession and submits within 7 days
                  a statement from the Veterinarian stating the disease in which Said Dog was suffering from on the date of arrival.  Said
                  Dog will be replaced, provided that Buyer agrees to pay the shipping cost of such replacement.  Replacement will be
                  selected by Seller from the next available litter, should a dog of equal value not be available at that time.  Seller’s liability
                  shall be limited to one such replacement.
 

      4.         After receiving all monies due Seller agrees to provide Buyer with an AKC limited registration application or certificate
                  with the agreement that said dog shall be spayed or neutered no later than 12 months of age.  Buyer agrees to provide Seller
                  with a statement from a Licensed Vet verifying such alteration.  Said Dog is not for breeding purposes.  Should Said Dog
                  be allowed to reproduce either by choice or by accident, then Buyer agrees to pay Seller  the sum of $2500.00 in lieu of
                  damages to Seller name plus $2l500.00 per puppy.  Buyer is required to  return Said Dog to Seller along with AKC   
                  papers plus pay all transportation charges in returning of Said Dog.

     5.          Transfer of Ownership:  Said Dog is not for resale, placement, or disposal in any form without the written approval from
                  Seller.  Seller agrees to take back  Said Dog and refund one half of original purchase price for a  period of up to seven (7)
                  days after Buyer has taken possession of said dog.  Seller to have 45 days to pay this amount.  After seven (7) days Seller
                  agrees to assist with the placement of Said Dog should Buyer be unable to keep or desire not to keep said dog.  Should
                  Keeshond Rescue assist in the placing of Said Dog, then Buyer agrees to donate the sum of $200.00 to Keeshond Rescue to
                  assist in the care and placement of Said Dog.  Buyer agrees not to release said dog to Keeshond Rescue without the written
                  approval of Seller.  If no satisfactory home can be found, Seller requires that Said Dog be returned  with no money being 
                  refunded to Buyer.  Any and all transportation expenses are to be paid for by Buyer.  It shall be a condition of this contract
                  that the new owner of Said Dog shall execute an identical agreement as this one with Seller.  Seller retains the right to 
                  approve or deny any potential new Buyer or Owner.  At no time shall Said Dog be transferred, sold, or given as a gift or in
                  any other manner to be allowed to be obtained by any animal retailer, wholesaler, laboratory, shelter, or anyone who deals
                  with the selling of dogs in any commercial manner.  Buyer agrees to inform Seller of any change of address while owning
                  Said Dog.        

      6.          Buyer agrees to provide Said Dog with adequate shelter by living in the home.  Said Dog shall be kept in a clean, safe
                   home environment, provided with daily exercise and SHALL NOT be tied, chained, or bound at any time, nor is Said Dog
                   to be allowed to roam free without owner supervision.  Said Dog shall be fed a quality diet recommended by the Seller and
                   fresh water shall be provided at all times.

      7.           Seller recommends (not required) that Buyer have Said Dog tattooed or microchip for identification purposes in case
                    Said Dog is lost or stolen.  
 

      8.           Buyer agrees to inoculate Said Dog against infectious diseases, check for heartworm on a yearly basis and provided
                    monthly or daily heartworm preventative medication, according to his Vet’s recommendations.
 

9.           Seller guarantees that the Sire and Dam of Said Dog has been screened for Hip Dysplasia, Patella Luxation, Inherited Eye Diseases
      and PHPT prior to being bred.

     10.           Seller highly recommends that Buyer take Said Dog to one puppy kindergarten class by the age of 4 months and one
                     basic obedience class by the age of 6 months.  A Canine Good Citizen title is encouraged but not required.   
 

     11  .         Buyer agrees to assume full financial responsibility for the health care of Said Dog.  Seller is not liable for any expenses
                     incurred after Buyer  takes possession of Said Dog.
 

     12.           This contract agreement is in accordance with the Laws of Oklahoma.  Any dispute concerning this contract or said dog
                     shall be settled in the County of Adair, State of Oklahoma.   
 

13.          This contract is legal and binding.  Should any part of this contact by violated by Buyer, then Buyer agrees to pay Seller
       the sum of $5000.00 in damages to Seller with owner ship of Said Dog reverting back to Seller.
 

14.          Additional Form Clauses shall be listed as follows and are a permanent part of this contract.
 












 

Said dog is purchased “AS IS” and Seller does hereby disclaim any and all other warranties, whether 
expressed or implied, except those described above or attached.  The cost (taxable, disbursement, and
fees actual or punitive) or any litigation which arises regarding the fulfillment of this contract and agreement
will and shall be born by the Buyer.  Upon signing of this agreement, both parties agree that they have read 
and fully understand this agreement.
